Can I purchase the property before the sale?

Yes, but the owner(s) would have to sell it to you. The lien holder or mortgage company who brought the action does not have the authority to sell it.

Can I see or inspect the property before the sale?

The master commissioner does not have the authority to grant access to a property prior to a sale.

Can a sale be cancelled?

Yes. Cancellations may occur at any time prior to the sale.

How do I complete a title search?

Documents affecting a property’s title may be found in various places, including but not limited to the Madison County Clerk’s Office. Questions regarding title searches should be directed to an attorney.

How do I get keys to the property?

If the Plaintiff’s attorney does not have keys for the purchaser, the purchaser will have to get a locksmith. The master commissioner does not have keys.

What does the amount to be raised mean?

The amount is the debt owed to the party seeking to satisfy their judgement debt and may or may not have anything to do with the property value.

What happens if the purchase price is 2/3 (two-thirds) of the appraisal?

There is a 6 month right of redemption.

What is a right of redemption?

The property owner may have the opportunity to pay back the purchaser within 6 months from the sale, and with 10% interest per annum. See KRS 426.220.

Where can I get a list of current properties?

This information is available on our website, which is for information purposes only. The official list of properties to be sold is advertised in the Richmond Register and copies are also posted at the Madison County Circuit Courthouse (lobby); notices of sale are also posted on or about the property itself.

Who do I contact when there is still someone living on the property?

The master commissioner does not have the authority to evict any tenant or other person from a property. If an eviction is required, it is strongly recommended you contact an attorney.
